GENERAL PROVISIONS
1.00 Severability.  The invalidity of any element or elements of these regulations shall not affect the validity of the reminder.

2.00 Compliance.  Compliance with these regulations does not relieve anyone from complying with all other applicable federal, state or local statutes, by-laws or regulations.

3.00 Penalty.  Anyone who violates any regulation of the Wellesley Board of Health shall be subject to a fine of $200.00 except when otherwise provided by law.  When permitted by law, each day of the violation shall be considered to be a separate offense.

4.00 Fees.  The Wellesley Board of Health shall annually review fees for all permits covered by these regulations.

5.00 Appeal.  All decisions by the Director of Public Health may be appealed to the Board of Health.  Such appeals shall be filed in writing at the offices of the Wellesley Health Department.  Any such appeals must be filed within seven (7) days of the decision in question.

6.00 Variance.  The Board of Health my grant a variance to any of these regulations if the applicant can demonstrate to the Board's satisfaction that an equal degree of safety can be provided without strict application of the provision in question, or when the enforcement of the regulation would cause manifest injustice. The Board may not grant any variance that would conflict with the spirit of the minimum standards established by these regulations or any state regulations.

a.  A variance hearing may not be held without first being publicly advertised in a newspaper published in the Town.  The cost of this notice shall be borne by the applicant.  The notice must be published at least ten (10) days before the hearing date.
