Mike Toohill, Paul Deyesso, Bill Sansone and Martin Ryan represented the Country Club. A large number of concerned citizens attended and participated in the discussion.
The WPC stated they had conducted a site inspection on November 10, 2010 of the alleged violations within Riverfront Area at the Brookside Road area of the Wellesley Country Club. The WPC stated they reviewed all items at the site as documented in the letter submitted by the Friends of Brookside dated November 2, 2010. The WPC clarified that this discussion is to focus on the alleged violations and not on the ongoing review of Notice of Intent, MA DEP File #324-648.
The audience asked when Beals and Thomas peer review report would be made available to the public. The Administrator noted he anticipated receiving the report on December 15, 2010 and would distribute to the WPC, Country Club team and representatives of the Friends of Brookside as soon as it became available. The WPC noted they would not be meeting again on the Club’s NOI until a date to be determined in January.
The WPC reviewed and discussed the items in the Friends of Brookside letter with the audience and representatives of the Country Club. The WPC first discussed the open, dirt lot area adjacent to the Brookside Community Gardens and focused on the Friends of Brookside’s allegations associated with the portable toilets, existing silt fencing and existing piles of rock, sand, landscape debris and plugs of soil from course aeration operations. The WPC noted that the portable toilets had been removed prior to their November 10 inspection. The WPC noted that they determined the existing silt fencing and piles of sand and stone were left in the area from the Academy Brook Restoration project. The open lot had used as a staging area for the project that was permitted under open and valid Order of Conditions, MA DEP File #324-565. The WPC
concluded materials and the silt fence associated with the Brook Restoration project can be located in this area but in a manner that fully complies with the Order of Conditions. As such, the WPC determined that silt fencing associated with the Brook project should be restored and some of the materials associated with the project should be moved further away from Brookside Road to comply with the Order of Conditions.
The WPC, audience and Country Club representatives discussed the existing stockpiles of landscape debris (branches, leaves, etc) and aeration plugs (small cylinders of soil and turf) in this area. The Club noted they have routinely stockpiled such landscape maintenance debris in this area for many years. Materials collected from the proximate portion of the course are collected in this location prior to being permanently relocated to the Club’s existing compost area in a different area of the property in the Town of Needham. The audience expressed strong concern regarding the potential for concentrating and leaching of pesticides and herbicides in the Riverfront Area from the aeration plugs taken from treated portions of the golf course. Members of the audience contested that the stockpiling of debris from regular landscape operations
constituted “dumping and/or filling” within the Riverfront Area and advocated for the immediate removal of the stockpiled material, advocated for the testing of the material for the presence of noxious herbicides and pesticides and advocated for the issuance of a fine for the alleged violation of the wetlands laws. The WPC debated and determined that the stockpiling of regularly generated landscape maintenance debris, including aeration plugs, was not permitted in the Riverfront Area in this location as part of the Academy Brook Restoration Order of Conditions. The WPC noted that the stockpiling of such material without a valid Order of Conditions permitting the activity must cease and existing debris must be removed. The WPC noted they would draft and issue an Enforcement Order to this effect. Representatives of the Club noted the debris would be removed after the WPC issues a written decision on the matter. WPC determined that the issuance of a fine was not warranted
to prompt compliance with the Act and Bylaw. The WPC determined that testing of the aeration plugs for the presence of pesticides/herbicides was not necessary at this time. Members of the audience reiterated that testing should be required. The audience noted that existing stormwater runoff flows from the open dirt lot area onto Brookside Road and creates icy conditions in the winter. The Club agreed to install an erosion control barrier across the entrance to the area to help curb the problem during the winter.
The WPC, audience and Country Club representatives discussed the access points into the golf course from Brookside Road. Audience members and Friends of Brookside letter contended that the access points were created without wetlands permits. The Club presented aerial images of the area from the 1960s and 1994 that illustrate the access points appeared to have existed prior to the adoption of the Riverfront Area regulations and Wellesley Wetlands Protection Bylaw. The WPC noted they did not see any evidence at the site that indicated any recent cutting had occurred. The WPC noted the installation of signs and chains into the trees was not ideal but noted they did not have any major concerns regarding the installation of signs and/or chains into trees owned by the Club.
WPC member Mr. Hammerness spoke in reference to the letter submitted by wetlands consultant, Patrick Garner on behalf of some of the neighbors who are concerned about the project. Mr. Hammerness noted that the letter indicated Mr. Garner was not granted permission to enter the Club’s property during his review for the neighbors. Mr. Hammerness noted the Club should consider allowing Mr. Garner on their land to conduct a review of the proposed work area but also recognized the Club does have the right to restrict access to their land. Mr. Hammerness also noted that Mr. Garner can suggest alternative sites for locating the project for consideration in the Riverfront Area performance standard reviews.
The WPC reiterated that an Enforcement Order would be issued requiring clean up of debris and repair/replacement of the erosion control barrier associated with the Academy Brook Restoration Project; requiring the removal of all landscape maintenance debris and ceasing of using the area within Riverfront to stockpile landscape debris in the future without a valid Order of Conditions for such activity.
The WPC noted that a public hearing on the NOI would be scheduled for sometime after the peer review report has been submitted by Beals and Thomas.

Denny Nackoney of the Wellesley Trails Committee discussed an ongoing minor encroachment issue behind 89 Ledgeways at the Rockridge Pond conservation area. The Conservation Administrator noted that as part of a larger project and under an Order of Conditions, the property owners and DPW worked together to replace an defunct municipal stormwater system outlet. The pipe ran through the 89 Ledgeways property and outlets in Rockridge Pond. The pipe had been replaced and Order required the surrounding disturbed area to be returned to a natural condition. The property owners had installed a large amount of gravel around the pipe and sod over an area that was formally brush. Mr. Nackoney and Administrator noted that the neighbors were contacted and directed to naturalize the area. Mr. Nackoney noted that the turf was still maintained and area is
not being allowed to go natural. Mr. Nackoney requested permission to remove the sod and install leaf litter and debris to allow the area to start to naturalize on its own. The WPC and Mr. Nackoney clarified that the only area work is proposed is on the Town owned conservation land. Mr. Nackoney confirmed.
The WPC discussed Mr. Nackoney’s request and endorsed the work he requested to do. The WPC noted they will issue a letter alerting the property owners at 89 Ledgeways of work to be done by Mr. Nackoney and the Trails Committee and notifying them of their obligation to allow the area to naturalize.

Janet Bowser, Director of the Wellesley Natural Resources Commission, Steve Fader, Town Engineer, Bill Millet, Wellesley DPW and Steve Riderby of GZA GeoEnvironmental, Inc were present for the applicant.
Ms. Bowser presented a brief overview of the Town’s Fuller Brook Park Preservation Plan that is currently being developed. Ms. Bowser noted that an NOI on this project would likely not be filed for a year or so but that the majority of proposed work on the project would be within wetlands and Riverfront Areas.
Mr. Riderby presented a general overview of the wetland resource areas associated with Fuller Brook Park. The WPC noted that the Administrator had reviewed the delineation in the field and that there were some questions regarding some of the Bordering Vegetated Wetlands lines as well as some issues with notations on the ANRAD plans. The WPC instructed the Administrator to meet with Mr. Riderby at the site and review the areas of the delineation of concern. The Administrator also noted no MA DEP File had been issued and the WPC cannot close the hearing until that information is available.

The Administrator updated the WPC on the status of their review. At the previous hearing the WPC and applicant agreed to either peer review the project for compliance with MA Stormwater Management Standards or see if Associate WPC Member Derek Redgate, a civil engineer, would have time to review. Mr. Redgate was not able to review. The Administrator reported he had updated the applicant and the applicant stated they were amenable to funding a peer review of the NOI for compliance with MA Stormwater Management Standards.
The WPC voted 3-0 to hire a peer review consultant and instructed the Administrator to solicit 3 proposals for reviewing the NOI for compliance with MA Stormwater Management Standards. The WPC continued the public hearing as an administrative matter.

Tom Wirth, Thomas Wirth Associates, Richard Westcott, Westcott Site Services, Joanna Travis, present for the applicant.
The WPC Chair noted he was not at the last discussion on the project and was updated on the discussion.
Mr. Wirth presented an overview of the proposed project and noted revisions to the proposed plan and additional supporting information the applicant had submitted since the NOI review began. The WPC noted that the plan revisions and additional information submitted by the applicant appeared to address the WPC’s concerns stemming from the proposal’s original No Disturbance buffer zone impacts, potential issues associated with bordering land subject to flood and potential for the project to exacerbate existing flooding issues in the neighborhood and planting. The WPC requested Mr. Westcott to provide an overview of findings on the potential flooding related concerns. Mr. Westcott noted based on his review, he did not believe the proposed project would change the flood potential of the site or general area.
Ms. Travis summarized that the proposed project would have less impervious cover than the site originally had prior to the project completed under MA DEP File #324-560 and that this Order did not specifically stipulate that no new pool could be constructed on the lot. Ms. Travis noted that the proposed project’s compliance with wetlands law performance standards is the issue at hand, not the issue of pool removal as mitigation in File #324-560 and the now proposed pool installation. Ms. Travis noted she believed the proposal meets performance standards and was sensitive to the concerns of her abutters.
The WPC discussed the neighbor’s flooding related concerns and noted that Mr. Westcott’s letter appeared to evaluate the concern and conclude no impact from the proposed project on flooding related issue.
The WPC members discussed the language in Order of Conditions MA DEP File #324-560 regarding the 2007 removal of a pool. The WPC noted this Order stipulated that removal of the pool in 2007 was considered very significant in allowing the overall project to be approved under the wetlands laws. The WPC also noted that this Order did not specify that another pool could never be proposed or constructed on the lot within areas subject to wetlands laws. The WPC noted they must carefully consider how to make a decision on the current proposal while respecting the WPC’s past Order.
Mr. Scott Sefton and Ms. Mary Jo McGee, abutters, presented a letter and reviewed two poster boards of photos taken of their property and others in the surrounding neighborhood. Mr. Sefton summarized that cumulatively the development has greatly increased the impervious cover in the neighborhood and that their property sits at the lowest point in the neighborhood, adjacent to a culvert where the wetlands and intermittent stream flow under Ridge Hill Farm Road. Mr. Sefton noted that all of these projects and the one proposed under this NOI have or will increase flooding on his property. Mr. Sefton questioned the validity and accuracy of Mr. Westcott’s engineering review. Mr. Sefton requested the WPC to hire an independent engineer to peer review flooding related concerns. Mr. Sefton also noted that he believed the culvert adjacent to
his property was undersized and that he would like the WPC to work with the DPW to increase the size of the culvert.
Mr. Westcott described his methods for evaluating the NOI and discussed how he came to his conclusions. Mr. Westcott noted that the neighbors do have flooding issues and legitimate concerns but that the proposed project will not make the existing issue any worse.
Mr. Sefton advocated for a peer review of the proposed project and advocated for the Town to increase the size of the culvert at his property. The WPC noted that did not believe a peer review of the NOI was warranted and noted they cannot require the Town DPW to enlarge the culvert. The WPC noted they could issue a letter to the Town Engineer regarding the matter.

Ms. Kendall presented an overview of the proposed installation of a new gas line within the buffer zone of an intermittent stream and Bordering Vegetated Wetlands. The Administrator noted he and Mr. Hammerness reviewed the site earlier in the day. The WPC and Ms. Kendall discussed the proposed work and clarified no vegetation removal was proposed, erosion controls would be implemented and that the trench would be backfilled on a daily basis.

Annalisa Weigel and Thomas Wilhelm were present for the applicant.
Ms. Weigel provided an overview of the proposed landscape project in the Riverfront Area of Fuller Brook. The Administrator reported he and Mr. Hammerness had visited the site earlier in the day. The WPC asked for a list of proposed plantings. The landscape architect discussed the general native planting concept and noted he would follow up with a more formalized planting plan or list as soon as it was developed.
The WPC noted concerns with the minor erosion at the existing stormwater management system overflow outlet and with protecting the roots of existing trees from potential damage from excavation required to install the proposed retaining walls and patio. The applicant noted all excavation would be done by hand to minimize root damage and that they were agreeable to developing a simple solution to curb the existing minor erosion issue.
The applicant requested to close the public hearing.

Scott Smeyers of Oxbow Associates and Adam and Lauren Belmont were present for the applicant.
Mr. Smyers presented an overview of the proposed project to construct an addition in the Riverfront Area, Buffer Zone and Bordering Land Subject to Flooding associated with Boulder Brook. Mr. Smyers noted that the applicant has doubled the amount of proposed mitigation planting from 12 to 24 shrubs. The Administrator noted he and Mr. Hammerness had visited the site earlier in the day and noted a pile of landscape debris that should be removed from the Bank and No Disturbance Zone.
The WPC and project team discussed the proposed project and nature of the site. The WPC noted all proposed plantings should be located within the No Disturbance Zone. The applicant agreed. The WPC noted that compensatory storage appears to be provided per the Bordering Land Subject to Flooding Standards and Riverfront Area standards appear to have been met as well.
The applicant requested to close the public hearing.

Jerry Carr, Carr Research Laboratory, Terry Highline, architect and Riki Kveraga, property owner were present for the applicant.
Dr. Carr provided a brief overview of the proposed project to construct an addition to the single family house and install a large patio area. Dr. Carr noted drywells would be used to collect and infiltrate stormwater from the proposed addition but these were not shown on the NOI plan.
The WPC noted it appeared the NOI notes the project is located in the Buffer Zone of Bordering Vegetated Wetlands only but that it appeared that portions of the site and proposed work were in Riverfront Area and Bordering Land Subject to Flooding associated with Caroline Brook. The WPC noted the NOI forms submitted did not appear to be the most updated version of the forms and also noted that the application lacked enough information for them to review to determine if the project complied with wetlands laws or not. The WPC requested the applicant submit a more detailed NOI plan and supplemental written narrative describing the project and its compliance with wetlands regulations.
The applicant requested to continue the public hearing.

The Administrator reported that he recently spoke with the applicant who indicated they are continuing to gather additional information and anticipated reporting back to the WPC in January 2011.

Meeting Minutes:
The Administrator reported he recently emailed Dr. Gimeno draft minutes and was awaiting his submittal of comments. The WPC noted they would wait to take action on the draft minutes until Dr. Gimeno’s comments were reviewed and incorporated.
Conflict of Interest Information and Signature Sheets:
Several members of the Friends of Brookside attended this discussion. The Friends inquired what this matter was about and if it had anything to do with the Wellesley Country Club NOI. The Administrator presented the Friends group with a copy of the information submitted to the WPC as issued by the Town Clerk. The Administrator summarized that the Town is required to provide a copy of Conflict of Interest information and collect signatures of all employees and board members who the information is distributed to.
WPC member J. Stanley Waugh noted he signed and submitted the form to the Town Clerk.

The WPC reviewed the draft Order and had no edits or comments.
A motion was made by Jay Hammerness and seconded by J. Stanley Waugh to issue the Order of Conditions. The WPC voted 3-0 to issue the Order of Conditions.
2011 WPC Meeting Calendar
The WPC discussed the proposed meeting calendar. Members noted conflicts with January meeting dates and determined workable meeting dates for January to schedule were Tuesday, January 4, 2011 and Thursday, January 27, 2011. The WPC noted that meeting dates beyond these two would need to be worked out in January.
WPC member J. Stanley Waugh reminded the WPC that he would be out of Town for the months of February and March and noted the difficulties this would pose on any outstanding business, including the Country Club NOI that he is involved in.
182 Winding River Road – MA DEP File #324-471 – Scrivener’s Error Correction
The Administrator reviewed the letter and attached Certificate of Compliance form intended to correct the Scrivener’s error the WPC previously discussed on this matter.
The WPC signed the letter and forms.
Discussion with Bob Collins
The Administrator noted that he and the NRC Director and Chair had met earlier in the day with Mr. Collins who is interested in potentially serving on the WPC. Mr. Collins noted he stayed for the entire WPC meeting and was very interested in the work of the WPC and processes they follow. The WPC and Mr. Collins discussed his interest in serving and discussed the time commitment, general nature of what is expected of the WPC, role of the Administrator, etc. Mr. Collins noted he would like to serve as a member of the WPC. The WPC noted they would enthusiastically recommend his appointment by the Natural Resources Commission and thanked Mr. Collins.
